For anyone who has recently applied to SCOTUS or for those who may yet apply, you must watch the invaluable interviews Bryan Garner has conducted with eight of the nine Justices regarding, in part, what the Justices expect from their law clerks.

They are lengthy, but well worth watching as each Justice has slightly (or drastically) different expectations of their clerks.

A helpful comment from last year's site:

"For OT 2010 clerkships, you should apply early (Nov - December '08) to all of the Justices. Then, have your judge update your application with a recommendation in September '09 after you have been in the clerkship for a little while.

Generally, the Justices who hire in January are hiring applicants who have been out of law school for a year or more who applied in previous cycles. But it never hurts to have your application in with them, and you certainly should apply before April '09. There is little risk that your application will be forgotten because the Justices generally only look at new-graduate applications when they are ready to hire---not as they come in."

How to apply for a Supreme Court clerkship

One of my commenters noted that the application process for Supreme Court clerkships is remarkably opaque and that if you don't have someone to explain it to you it puts you at a disadvantage (does this disadvantage women who have less access to existing old-boy networks?). HLS helpfully outlines this process, but it puts the information behind password protection. Information, however, wants to be free, so I'm summarizing it for you below. Enjoy!

(If any of this information is out of date, please let me know and I will correct it.)

Applications for October Term N should be sent in March - June of N-1. Thomas hires much further in advance, so take this into account.

Apply to all nine justices even if you don't think you'd like to clerk for some of them.

Your package should include

a short cover letter containing the names of your recommenders, the contents of your packet, and the term you are applying for
a resume
a transcript
a writing sample consisting of a scholarly note, comment, or article
recommendations from professors, judges, or very famous practitioners
Send updates to your materials as needed.

To prep for an interview, read the justice's opinions, especially those from the recent term. Do not contact current clerks even if you know them.

Idiosyncracies of the justices:

Roberts: 2 recommendations (may have changed)
Stevens: short writing sample is optional. At least 2 recommendations from professors, at least 3 total.
Scalia: 3 recommendations. Note names of professors on your transcript.
Kennedy: two writing samples and 3-5 recommendations required.
Souter: 3-5 recommendations, including one from your circuit judge. Academic writing samples a must!
Thomas: at least 2 recommendations.
Ginsburg: at least 3 recommendations. Short writing sample plus a reprint of any academic publication you have.
Breyer: 3 recommendations, including one from your circuit judge. Short writing sample.
Alito: unknown!"

Doubt it all you want. Scalia typically starts interviewing in April, and this year is no exception.

And look at the Justices who have already hired for 09: Ginsburg, Alito, Kennedy, Breyer and Thomas. They obviously interviewed their hires.

Generally the next predictable Justices will wait until September - October. Souter usually doesn't hire until the spring, Thomas has always been unpredictable, and as far as I can tell Alito's timing hasn't been established yet.

I have a question if any of you would be so kind as to provide me with an answer! I had thought it common practice that district court and appellate judges would write letters of recommendation for their clerks when they apply to the Supreme Court. However, I was recently informed that it is a violation of the Judicial Code of Ethics for a federal judge to write any letter of recommendation for a law clerk.

Does anyone know whether or not that specific regulation applies to letters of recommendation to clerk on the Supreme Court?

I have not heard about that rule before. I know that Justice Souter specifically requests that your application include a letter of recommendation from your current judge; his Chambers sends a letter confirming receipt of your material and asking for a letter from the judge for whom you are clerking, by a particular deadline. So that seems to contradict whatever ethics rule you found.

As best I can tell, your question triggers Canon 2(B) of Model Code of Judicial Ethics. In relevant part, that Canon states: "A judge shall not lend the prestige of judicial office to advance the private interests of the judge or others; nor shall a judge convey or permit others to convey the impression that they are in a special position to influence the judge. A judge shall not testify voluntarily as a character witness."

From this, an obvious question arises: If your judge is giving you a letter of recommendation, is he trying to influence the recipient by the prestige of the judge's official position? Simply put, if your judge writes you a letter without forming a her own opinion of your abilities as a law clerk, the judge is likely in violation (or, at least, not in compliance with the spirit) of the Canon.

Notice, too, the following commentary accompanying the Canon: "Although a judge should be sensitive to possible abuse of the prestige of office, a judge may, based on the judge’s personal knowledge, serve as a reference or provide a letter of recommendation."

Bottom line seems to be that you're on solid ground to ask and receive a letter of recommendation based on your judge's personal experience with you. That's why countless judicial clerks have come to rely on their former bosses for a recommendation. It matters not, it seems, whether your judge is recommending you for a Supreme Court clerkship or for any other job. What matters is that your judge has some basis for recommending you. If he does, there are no obvious ethical problems.

10:30--Stevens, Scalia, Souter, Thomas, Ginsburg, and Breyer send letters or postcards confirming receipt of applications.

3:37--the hiring process is spread out since each Justice operates on his/her own schedule. Most justices do not do "screening" interviews. Some justices have already hired for 2010-2011. The earliest that current 3Ls will be interviewed and hired is probably May or so.

The gross medical negligence fraud cover-up was a premeditated hate crime and involves the avoidable, premature loss of a SIBLING kidney transplant with life threatening consequences. The doctor and others (I was being harassed for no reason at a fitness club. My tire was slashed; they tried to run me off the road many times, and followed me everywhere. Police were notified, but nothing was done.) knew for 3 years that my blood tests were abnormal indicating organ rejection, but I was not told as required by law. I found out on my own that my blood tests were abnormal. I could have died with fluid filling my lungs. Prior to my finding out about the abnormal blood tests, illegal surveillance (cameras were placed in lights, central air vents, phone taps, and listening devices in phones, etc.) were placed in residences and work place of myself, family and others to prevent me from contacting an attorney and honest law enforcement to stop the ongoing criminal actions and pursue the gross medical negligence with depraved indifference and malice escalating the case to gross human rights violations. The case is straight forward, multi-state, and has no statute of limitations due to extensive discovery abuse violations, wrongful deaths of family members, and ongoing criminal actions.
I have almost died several times due to ongoing criminal acts of cruelty and terrorism. I have been illegally detained 4x (3x in Baton Rouge, LA where corruption is common) and while detained, evidence and money were stolen as well as intentional criminal misdiagnosis to discredit me so justice would not occur. My sister, Pamela L. Price 506 ½ North Park Street McLeansboro, IL 62859 (phone 1-618-308-2409), has been illegally incarcerated as an intimidation tactic so I would not seek justice. All my efforts to obtain justice for her have been illegally blocked. Persons are illegally trying to take custody of her children, grandchild. Pam gave copies of evidence for me to a Carbondale, IL FBI Agent in 2003, but no action was taken as required by law as probable cause was established. Pam is in need of an attorney and emergency funds immediately as I do.
I also prepared a detailed account of human rights violations and placed the info on several free e-mail accounts (yahoo, myway, fastmail, Inbox, Care2), but persons illegally blocked access to opening several (yahoo, myway, fastmail) so I and others could not send or retrieve info to help me obtain justice. All e-mails sent did not arrive to addressee.
Due to the inaction of those contacted with a legal obligation to investigate, protect my rights, I filed a pro se civil action lawsuit, 05-1302-JVPr-SCR, on 11/3/05 in federal court (777 Florida St. Baton Rouge, LA 70801). The pro se lawsuit was written as such that its denial on any grounds would be a violation of the U.S. constitution as copies of evidence were enclosed. Post filing, proper legal procedure was not followed. Due to the unusual nature of the lawsuit, I included a Bill of Determinants with details of human rights violations along with 100pps. + of copies of evidence so the court could take immediate action. None was taken. Attempts to file Writs of Certiorari (where original jurisdiction was established) with individual U.S. Supreme Court Justices Breyer, Ginsburg, Stevens, and Kennedy were illegally blocked. One writ document appeared on my doorstep on Saturday, Sept. 3, 2006-mail is not delivered on Saturday! Attempts to contact the U.S. Federal Court of Appeals 600 S Maestri Place New Orleans, LA 70130 on 8/16/07 to file a Complaint of Misconduct (07-05-351-0117, 0118) was also blocked. Proper legal procedure was not followed. I also filed a Petition for Review for the Judicial Review Commission at the U.S. Federal Court of Appeals. It was sent by certified mail, but it was never delivered according to track & confirm. I received a response anyway stating the complaint was dismissed. I sent another copy of the Petition for Review on 9/4/07 to U.S. Federal Court of Appeals 300 Camp St. New Orleans, LA 70130 (I was given two different addresses), but there was no response. Mail fraud continued blocking all attempts to get the human rights violations settled in court, another human rights violation. Documents were signed by deputy clerk Shelley Saltzmann whose name appeared as a judge on an internet site of the Court of Appeals.
Human rights violations: denial of 1. freedom of religion (right to self-determination), 2. freedom of speech (right to speak the truth), 3. right to legal counsel, 4. right to privacy, 5. right to all personal property, 6. right to economic freedom, 7. right to due process, 8. right to equal protection, 9. right to basic health care of my choice. Medicare Fraud, Legal malpractice, Medical Negligence Fraud Cover-up are also involved.

Based upon my limited experience with nominated judges for circuit courts, judges pretty much refuse to discuss potential clerkships until after the confirmation. That said, you should be talking to professors with connections to Sotomayor who might help, and you should be prepared to drop a FedEx package in the mail the day the Senate votes. She's got too much on her plate to worry about clerks she may never have if she doesn't get past the confirmation process, so relax.
